TERMS OF SERVICE — KIEV

By commissioning artwork from Kiev, you acknowledge that you have read, understood, and agreed to all the terms listed below. Please read them carefully before making any payment to avoid misunderstandings during the commission process.

01. General Terms

● Right to Refuse: I reserve the right to refuse any commission for any reason, without being obligated to accept requests that do not fit my availability or artistic boundaries.● Order of Service: Commissions are completed in the order they are received and payment is confirmed.● Communication and Respect: Please avoid sending frequent messages requesting updates or contacting me on my days off. If any unforeseen circumstances arise, I will notify affected clients as soon as possible.● AI and NFT Usage: I do not authorize the use of any artwork created by me, including past works, for artificial intelligence (AI) or machine learning (ML) training, nor its transformation or use in the creation of NFTs.● Artwork Resale: Reselling my artwork for a price higher than the original purchase price is not permitted without prior communication and authorization from me.● Provided References: Clients are responsible for ensuring that the references they provide come from legitimate sources and that their use is authorized whenever necessary.● Copyright and Portfolio: I retain the copyright to all artwork I create and reserve the right to share it on my social media platforms and include it in my portfolio, subject to any prior confidentiality agreements.● Personal Use: Unless an additional license is purchased, commissions are intended exclusively for the client's personal use, including profile pictures, banners, stickers, personal prints, and sharing on social media. Monetized or commercial use requires the payment of the applicable additional fee, as outlined in Section 04.

02. Production Time, Revisions, Updates, and Delivery

Estimated Production Time● Estimated Completion Time: commissions typically take between 3 weeks and 2 months to complete, depending on the project's complexity, size, and current queue.● Delivery Estimates: the estimated timeframe is not a guaranteed deadline. Your commission may be completed earlier than expected.● Rush Orders: I do not accept rush orders or commissions with deadlines shorter than:
○ 1 week: small commissions or projects of standard complexity.
○ 2 months: large projects, such as character design sheets and extensive illustrations.● Specific Deadlines: clients must communicate any specific deadlines before making a payment. Requests for exceptional deadlines will depend on my availability and require prior confirmation.Sketches and Revisions● Initial Sketch: I generally send the first sketch the day after payment is confirmed, although it may be sent on the same day. This initial timeframe does not represent the total completion time.● Included Revisions: clients are entitled to 3 revisions during the sketch stage, allowing them to request adjustments to the composition, poses, visual elements, or other project details.● Additional Revisions: extra revisions may be subject to an additional fee, which will be communicated before any adjustments are made.● Sketch Review: I recommend gathering all requests and carefully reviewing the sketch before approving it.● Changes After Approval: once the sketch has been approved, further changes may be declined or charged separately, depending on the production stage and the complexity of the requested adjustments.Updates and Unexpected Circumstances● Progress Updates: clients may request an update on their commission 2–4 days after the last update, while respecting my days off on Saturdays and Sundays.● Delays and Unexpected Circumstances: if any unforeseen circumstances affect the production timeline, I will notify the clients involved through a private message or the “Announcements + Updates” card on my Trello board.● Communication Channels: I primarily handle commissions through Discord and X (Twitter). Please prioritize these channels, as my other social media accounts are checked less frequently.File Delivery● Delivery Methods: completed commissions may be delivered through one of the following methods:
○ Email (preferred);
○ Google Drive folder;
○ Discord chat.● File Storage: when files are delivered through Google Drive, clients are responsible for downloading and storing them. The folder may be deleted later due to storage limitations.● Permanent Folders: only returning clients are eligible for a permanent folder to store their commissions.● Backups: I strongly recommend keeping backup copies of all delivered files.

03. Payment

Payment Methods and Terms● Accepted Payment Methods: I accept payments via Pix and Wise.● Initial Payment: a 50% deposit of the total commission price is required before production can begin.● Remaining Balance: the remaining 50% must be paid once the artwork is completed, before the final files are delivered.● Additional Fees: any extras requested by the client will be added to the total commission price.● Monetized or Commercial Use: any fees for monetized or commercial usage must also be included in the total quote before production begins.● Start of Production: production will only begin once the initial payment has been confirmed.

04. Usage Licenses and Additional Fees

Usage Licenses● Personal Use: no additional fee. Includes private use, profile pictures, banners, stickers, personal prints, and sharing on social media for non-commercial purposes.● Monetized Use: an additional 50% of the commission's base price. Applies to uses intended to generate revenue, such as livestreams, emotes, PNGtuber assets, channel assets, videos, and other monetized content.● Commercial Use: an additional 75% of the commission's base price. Applies to artwork used in products or materials intended for sale, including physical or digital products, merchandise, custom items, and other forms of commercial exploitation.● Fee Calculation: license fees are calculated based on the total base price of the commission, before any additional license fees are applied.● Multiple Usage Types: if a project involves more than one type of usage, the applicable license must be discussed and agreed upon before production begins.Confidentiality● Confidentiality Fee: I do not charge an additional fee for confidentiality.● Prior Request: clients must request a confidentiality agreement before production begins and specify the date from which the artwork may be publicly shared.● Publicity and Portfolio: without a prior confidentiality agreement, I reserve the right to share the commission on my social media platforms and include it in my portfolio.

05. Cancellations and Refunds

Refund PolicyRefund eligibility depends on the stage of production at the time the cancellation is requested.● Before the Sketch Begins: you may cancel your commission and receive a 100% refund of the amount paid, provided I have not yet started working on the sketch.● After the Sketch Is Delivered: if you decide to cancel after receiving the sketch, you may request a 50% refund of the amount paid. This option is only available while the commission is still in the sketch stage and before the sketch has been approved.● After Sketch Approval: once the sketch has been approved, refunds due to client cancellation will no longer be available.● Cancellation by the Artist: if I am unable to complete your commission due to circumstances that prevent me from continuing the work, you will receive a 100% refund of the amount paid. The same applies if I decide to cancel your commission for any non-technical reason, regardless of the current production stage.● Cancellation During Advanced Production: if you decide to cancel your commission after production has progressed beyond the initial stages, no refund will be provided. In this situation, the artwork will be delivered in its current state, without any guarantee of completion or additional revisions.● Reconsideration Period: the project will remain available in my gallery for 3 days, allowing you to reconsider your decision and request that the commission be resumed.● Project Deletion: after this 3-day period, the project will be deleted and cannot be recovered.● Applicable Laws: refunds are not offered for reasons other than those specified in this section, subject to applicable consumer protection laws and other legal requirements.

WAITING LIST

◦ Free Registration: joining the waitlist is completely free and does not require any upfront payment.◦ Contact and Scheduling: I will contact you approximately 2–4 weeks before I am able to start your commission. At this point, you may withdraw without any consequences, confirm the proposed date, or choose another available date within the following three months.◦ Order Details: once your slot is confirmed, we will discuss the details of your commission, including the concept, pricing, and any additional requirements.◦ Cancellation After Payment: if you decide to cancel after making a payment, you may be blacklisted from future commissions, depending on the circumstances.Waiting Time and Availability- Estimated Waiting Time: the total waiting time cannot be accurately predicted, as clients ahead of you may withdraw at any time.- Monthly Progress: I typically move through 1–5 waitlist positions per month, depending on my availability, health, and project complexity. Occasionally, I may also open extra slots for CHIBI artwork or first-come, first-served commissions between custom projects reserved through the waitlist.
